Cineplex Store Privacy Policy

At CosmoBlue Canada Ltd., we share your concerns about the privacy and protection of your Personal Information (as defined hereafter). This privacy policy (“Privacy Policy”) describes the steps we have taken and our practices regarding the protection of your Personal Information.
This Privacy Policy applies to CosmoBlue Canada Ltd. and its wholly owned subsidiaries, affiliates, and related entities (collectively, “CosmoBlue” or “our”, “we”, or “us”). The contents of this Privacy Policy are intended to be read and understood in accordance and compliance with all applicable privacy laws, statutes and regulations in the jurisdictions where CosmoBlue operates. For greater clarity, this Privacy Policy does not apply to the operations of Cineplex Entertainment Limited Partnership (“Cineplex”) or its affiliates, including but not limited to its theatres and location based entertainment venues, websites or mobile apps, or the Scene+ loyalty program. The purpose of this Privacy Policy is to inform our visitors, customers and other individuals with whom we deal ("you" and "your") about how we collect, use, disclose, share, protect and otherwise process Personal Information.
This Privacy Policy applies to Personal Information collected, used, communicated, disclosed and otherwise processed by CosmoBlue in connection with (a) the products, services, devices, and applications provided under the Cineplex Store Terms of Use, available at https://store.cineplex.com/ (the “Cineplex Store”) (including for clarity the Applications and the Websites) and (b) Cineplex Store Customer Service. It does not apply to Personal Information of employees, job applicants and visitors of physical locations.

Definition of Personal Information
“Personal Information” is any information which relates to a natural person and directly or indirectly allows that person to be identified including, without limitation, information such as your name, address, birth date, personal contact information and other information described below.
It may also include other types of more technical information such as IP addresses, geolocation, device ID, or browsing history in connection with our Applications or Websites, but only when this information can, directly or indirectly, identify you as an individual. Information that is anonymized and cannot be, directly or indirectly, associated with an identifiable individual (such as certain data contained in “Reports” as defined below) is not considered to be Personal Information.
Personal Information We Collect Directly from You
CosmoBlue and its employees, agents as well as contractors, service providers, partners and representatives acting on its behalf may collect the following Personal Information that you provide to us:
- Contact Information that you may provide to us, for instance, when you create an account or make an inquiry through one of our Applications or Websites, by mail, telephone, email, SMS, social media, or any other means of electronic communication (e.g. name, home address, home or mobile telephone number or e-mail address);
- Credit or Debit Card Information, including card number, expiry date and CVS/CVV code that you may provide to us, for instance, when purchasing products or services;
- Information relevant to a particular service you request;
- Survey Responses that you provide (e.g. when you provide your name or other contact information in order to take part in a survey); and
- Preferences and other Personal Information provided by you through our Applications or Websites (e.g. including but not limited to language preference, gender, date of birth, profile picture, media preferences, favourite movie genres, movie reviews, and comments).
Personal Information collected by Cineplex on our behalf
You will be required to log into the Cineplex Store using your Cineplex Connect account. Cineplex acts as our service provider for the maintenance of the Cineplex Store and the Website.
In the event that you make a purchase through the Cineplex Store, Cineplex will collect on our behalf transaction information, including your name, email address, province of residence, language preferences and the title of your rental and/or purchase made through the Cineplex Store.
Personal Information We Collect Automatically
In some cases, we may collect information automatically which may not necessarily identify you directly as an individual. For instance, we may collect the following types of information:
- Technical Information. The nature of internet browsing is such that this activity passively and automatically collects and discloses certain information about an individual’s use of the internet. This information may be associated with an individual’s Internet Protocol ("IP") address. This is a unique internet "address" which is assigned to all internet users by their Internet Service Provider ("ISP"). Our server logs record statistical information, such as visitors' IP addresses, type of operating system, time and duration of visit, webpages requested, as well as identifying categories of visitors by items such as domains and browser types.
- Interest-Based Advertising. Our Applications and Websites also use cookies and similar tools for tailored interest-based advertising purposes. These cookies and tools may be placed by us or by our advertising partners. When you make use of our Applications or Websites, we collect information about the device you are using, including (as applicable) your Internet, telecom or mobile carrier and service provider, IP address, device ID, the date and time of your visit, the pages of the website you visit, the features of the Website or Application that you use, and the referring URLs you came from. Our Applications and Websites also make use of pixels, or transparent GIF files (sometimes called “beacons”), to help manage online interest-based advertising. These GIF files are provided by our ad management partners. These files enable us to recognize a unique cookie or code on your Web browser, which in turn enables us to learn which advertisements bring users to our Website, and track and report on the actions of users of our Websites.
- Location Information. Through your mobile device, you may have the ability to activate the location tracking functionality to allow CosmoBlue to access your GPS location. Activating location or device tracking functionality is a function of your mobile device and not required for your use of the Websites or Applications. By explicitly consenting to this collection and activating this feature, you agree to allow CosmoBlue to use your GPS location for purposes of providing you with offers or marketing messages relevant to your location. You further agree that CosmoBlue may collect and use your location information with the assistance of third-party service providers for the purposes identified above. We may use the location information you share with us in anonymized form(e.g. in anonymous and aggregate Reports as defined below and media performance measurement).
- Social Media Platforms and Other Third Parties. You may be able to log into our Applications or Websites using a social media or other accounts such as Google, Apple or Gmail (“Social Media Platforms”). The information that you provide to such Social Media Platforms to log-in to our Applications or Websites is governed by the privacy policy of the Social Media Platform. We will collect information that you have added in your registration profile from those accounts and which is made available to us by default by the relevant Social Media Platform. We may also collect Personal Information about you from your use of Social Media Platforms, through which you may allow us to collect (or a third party to share) Personal Information about you, such as details of your friends/connections, “likes”, comments you have shared, groups and location. We may supplement the information we collect about you directly with the information we receive from Social Media Platforms or other third parties to enhance our ability to serve you, to tailor our content to you and send you details of promotions and/or offers which we believe may be of interest to you, always in compliance with applicable laws.
Use of Your Personal Information
We collect and use Personal Information with your consent or as otherwise permitted or required by law, for general business purposes such as providing or delivering products or services, administering our business, Websites and Applications, preventing or reducing commercial risk as well as for purposes relating to information, system and network security. More specifically, we may use your Personal Information for the following general purposes:
- To process your purchases: We may use your Personal Information to process your purchases. For instance, personal contact and credit/debit card information will be used by CosmoBlue to process your purchases (this includes purchases made through our Applications or Websites, or the purchase or rental of movies through the Cineplex Store). In these cases, credit/debit card information is only used for the purposes required to process and complete the transaction and/or service requested by you and is only retained in transaction records required for internal management and auditing purposes or as otherwise required by law, unless you are informed otherwise, or you provide your consent.
- To Administer Contests: From time to time, CosmoBlue will administer contests online, which may include third-party business partners and third-party advertisers through our Applications or Websites. We may request your name, address, telephone number, e-mail address and we may also require proof of age for the purposes of determining contest eligibility. Unless otherwise stated in the applicable contest rules, your Personal Information will only be used for prize notification and fulfilment and related purposes in connection with the contest, and only as authorized by law or in accordance with this Privacy Policy.
- To Communicate with You. To the extent permitted by law, and subject to your right to withdraw consent and unsubscribe, we may use your Personal Information to communicate with you on our own behalf or on behalf of our advertising partners across multiple channels, including by email, SMS messages, telephone calls, Social Media Platforms and other platforms. This includes advertising and marketing messages about products or services that may be of interest to you. Individuals who provide us with their telephone numbers will only receive communications from us with respect to orders, contests or other products or services that they have requested if they provide express consent to receive commercial telephone calls or SMS messages from us.
- Surveys: CosmoBlue will occasionally conduct surveys and market research, by telephone or on our Applications or Websites. These surveys and market research may ask you about your preferences in relation to our services, your age, gender, approximate location, or other information that may assist CosmoBlue in understanding the preferences of its visitors and customers. Your participation in such surveys or market research is entirely voluntary and, in some cases, you may be able to participate anonymously. Your contact information, including your name, address, telephone number and/or other Personal Information may be required: (1) to permit you to enjoy bonuses or benefits which may be available to survey or market research participants (in which case your contact information will only be used for notification or fulfillment purposes); or (2) where you have provided your express consent to us contacting you to discuss comments that you made during our surveys and/or market research. Except as described in this Privacy Policy, survey and/or research responses are only used by CosmoBlue on an anonymized basis.
- To Operate, Improve, and Customize our Applications or Websites: We use information which you provide to us on the Applications or Websites to facilitate your registration of a Cineplex Store account, to understand the identity of our customers and the nature of their preferences, to improve the content of the Applications or Websites, to customize content and/or layout for each customer based on the information provided to us, to send periodic newsletters and marketing messages as requested, to process purchases, and to conduct surveys, polls and contests.
- To Better Understand Our Customers: We use information which you provide to us to generate aggregate and anonymous information and reports, lists or other data, created from our analysis of information we hold about you, including Personal Information, device ID, information we may collect about you through your use of the Websites or Applications, your transactional activity with us, and information we collect from our business partners and other third parties (“Reports”). From time to time, we may share Reports with select third-party business partners, advertisers, or other third parties.
- Other Uses: We may also use Personal Information, where necessary, for:
- establishing, maintaining and/or fulfilling relationships with our business partners, third-party vendors of products and/or services, as well as our corporate and business customers;
- understanding and assessing the interests, wants and changing needs of customers with a view to improving our products and services and developing new ones (for instance, we may assess the types of movies our customers prefer to determine which types of movies to offer in the future);
- creating custom audiences on Social Media Platforms and other platforms for the purpose of displaying personalized ads on those platforms based on your inferred interests or transactional activity with us; and
- conducting, operating, administering, and otherwise managing our business, to satisfy legal, regulatory, security, audit, financial and processing requirements, or as otherwise permitted or required by law.
- deploying and managing our information technology applications and systems, including managing our Websites and Applications;
- processing claims, answering the questions you pose to us and responding to comments you make to us with respect to our products and services. Please note that any Personal Information you disclose when calling Cineplex Store Customer Service will be used to process and respond to complaints or product inquiries.
When Your Personal Information Is Disclosed
In certain circumstances, we may disclose your Personal Information with third parties, to facilitate the operation of our business. We may disclose your Personal Information in the following circumstances:
- We may share your Personal Information with outside parties who sponsor or otherwise participate in contests, sweepstakes, or other promotions, whether on our Applications or Websites or otherwise. We will inform you of the identity of these third parties at the time we collect your Personal Information for the contests, sweepstakes or other promotions.
- Your Personal Information may be shared with our parent, subsidiary, affiliated and/or related corporations or entities, or to their employees, agents, contractors, representatives, servants, legal counsel and/or accountants without limitation, for operational, management and administrative purposes, as well as internal audit, legal, regulatory, security, insurance, financial, processing and other similar purposes, or as otherwise permitted or required by law. We may share your Personal Information with Scene Limited Partnership in connection with the operation and administration of the Scene+ loyalty program.
- Your Personal Information may be transferred to service providers, who may or may not be affiliates of CosmoBlue, where such entities provide services on our behalf (e.g. administrative, management, operational, processing, support, marketing or other services). For instance, we may use such third parties to host online services or administer our Applications or Websites, to identify common pre-existing relationships between you, us, and our marketing or advertising partners, to develop software applications, create and maintain databases, send and receive communications on our behalf, or we may retain vendors’ fulfilment houses, or survey, market research, or contest services providers. We provide them with a limited amount of information which is necessary for them to provide the services required. They are prohibited from using the information for purposes other than to facilitate and carry out the services they have been engaged to provide. These service providers are not permitted to disclose this information to others unless we authorize them to do so. CosmoBlue will strive to protect Personal Information shared with third parties with contractual agreements.
- CosmoBlue may share encrypted versions (such as a hashed version) of your contact information, including your email address, with third party service providers, Social Media Platforms and other platforms to enable us or our ad partners to serve targeted ads on the platforms and improve our online marketing campaigns.
- CosmoBlue may use and share your Personal Information with parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of CosmoBlue's business or assets, including for the purposes of permitting such parties to determine whether to proceed or continue with such transaction or business relationship, to fulfill reporting, audit, legal and/or other requirements or, in the case of sale or assignment, the use and sharing by those parties for substantially the same purposes described in this Privacy Policy.
- CosmoBlue may also share Personal Information necessary to meet legal, audit, regulatory, insurance, security or other similar requirements. For instance, CosmoBlue may be compelled to disclose Personal Information in response to a law, regulation, court order, subpoena, valid demand, search warrant, government investigation or other legally valid request or enquiry. We may also share information with our accountants, auditors, agents and lawyers in connection with the enforcement or protection of our legal rights. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful; or to report to law enforcement agencies in an emergency or where required or permitted by law.
All CosmoBlue employees, agents, contractors, service providers, partners and representatives who have access to your Personal Information are required to protect the information in a manner that is consistent with this Privacy Policy and any other policy and/or procedure, in effect from time to time.
Your Consent
Consent to the collection, use and sharing of Personal Information may be provided in various ways. Consent may be express (e.g. orally, electronically or on a form you may sign describing the intended uses and sharing of Personal Information) or implied (e.g. when you provide information necessary for a service you have requested), or in some circumstances where notice has been provided to you about our intentions with respect to your Personal Information and you have not withdrawn your consent for an identified purpose, such as by using an "opt-out" option, subject to applicable laws. Consent may be given by your authorized representative (such as a legal guardian, person having a power of attorney or a mandatary).
By providing us with Personal Information, we will deem you to understand this Privacy Policy, and we will deem you to consent to our collection, use and sharing of such Personal Information for the purposes identified or described in this Privacy Policy, if applicable, or otherwise at the time of collection.
IF YOU DO NOT AGREE WITH THE TERMS OF THIS POLICY, PLEASE DO NOT USE THE WEBSITES, THE APPLICATIONS OR OTHERWISE PROVIDE YOUR PERSONAL INFORMATION TO US.
Your Rights with Respect to Your Personal Information
You have certain rights with respect to our management of your Personal Information. These rights include:
- The right to request access to, or correction of, your Personal Information in our possession.
- The right to request information about how we have used and/or disclosed your Personal Information.
- The right to withdraw your consent or unsubscribe from certain communications (please refer to the section of this Privacy Policy titled “Right to Withdraw Consent and Unsubscribe”).
- For residents of the province of Quebec, you also have the right to data portability (i.e. the right to have the information we hold about you communicated to you or transferred to another organisation);

Access and Correction
CosmoBlue respects your right to access and correct your Personal Information. If you have an account with us, you can log into your Cineplex Store account at any time to access and update the information you have provided to us in the “Personal Information” section of the Website or Application. Additionally, CosmoBlue complies with all laws regarding access and correction. If you need assistance updating your Personal Information, please contact us using the contact information detailed in the “How to Contact Us” section below. Please clearly indicate the Personal Information that you wish to review or have changed. We will reply to your request as soon as reasonably possible.
Right to Withdraw Consent and Unsubscribe
You may withdraw your consent to our collection, use, disclosure and other processing of Personal Information at any time, subject to contractual and legal restrictions and reasonable notice. Note that if you withdraw your consent to certain uses of your Personal Information, we may no longer be able to provide you with certain products or services.
- Withdrawing Your Consent to Receiving Communications. Receiving commercial emails and SMS messages from us is optional and you may unsubscribe at any time by (a) following the unsubscribe link in any email or SMS message; (b) changing your communication preferences through your Cineplex Store account (if applicable); or (c) contacting us as indicated in the How to Contact Us section of this Privacy Policy. If you provide us with your mailing address, you may receive periodic mailings from us, or our business partners, with information on new products and services or upcoming events. If you do not wish to receive such mail from us, please change your preferences on the Applications or Websites, or contact us as indicated in the How to Contact Us section of this Privacy Policy.
- Withdrawing Your Consent to the Use of Cookies. You may opt-out of the use of certain cookies and pixels on our Websites and Applications. If you opt-out of interest-based advertising by a third party, these technologies may still collect data for other purposes, including analytics, and you may still see ads across the Internet, but the ads will not be targeted based on information about you, and may therefore be less relevant to you and your interests. Interest-based advertising opt-outs work by saving cookies in your browser that tell the various ad partners that you have opted-out. Because cookies are generally browser-specific, your choice will only apply to the web browser from which you opt-out. You must opt-out from each web browser from which you do not want interest-based advertising (and this may involve different devices, if you use more than one). You may opt-out of receiving customized or targeted ads on Social Media Platforms, which may be created through custom audiences using your email address or other contact information, by contacting us as indicated in the How to Contact Us section of this Privacy Policy. Please note that if you opt-out, you may still see some of the targeted ads on these platforms, but those ads will not be based on our use or sharing of your Personal Information.
Security, Retention and Destruction of Personal Information
We endeavour to protect your Personal Information using physical, electronic or procedural security measures as are appropriate and proportional to the sensitivity of the information in our custody or control, including safeguards to protect Personal Information against loss or theft, as well as unauthorized access, sharing, copying, use or modification.
On our Applications and Websites we store subscriber and password information in a secure manner not accessible to browsers, behind password protection, or off-line. We endeavour to use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our Applications and Websites.
We may keep and use information about you for as long as it is needed for the purposes set out in this Privacy Policy or to otherwise meet our legal obligations, even if you are no longer a customer. Personal Information that is no longer required to fulfill the identified purposes will be destroyed or made anonymous in compliance with our internal retention policies and procedures. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.
We have a variety of mechanisms in place to protect your Personal Information while in our custody, including:
- Internal policies and procedures that define the roles and responsibilities of our employees, representatives and service providers who may handle your Personal Information in the course of their employment with us;
- Physical, electronic and procedural safeguards that comply with relevant standards to protect Personal Information;
- If the information is collected or stored electronically, technical safeguards such as encryption, firewalls, passwords, anti-virus software or similar measures;
- A designated Privacy Officer to monitor CosmoBlue’s compliance with applicable privacy laws;

- Procedures for receiving, investigating and responding to complaints or inquiries about CosmoBlue’s information handling practices; and
- Contractual protections to ensure that service providers with whom we share Personal Information maintain adequate protections and security standards.
Confidentiality Incidents
Despite the foregoing security measures and significant steps CosmoBlue has taken to protect your Personal Information, no company can fully eliminate all security risks associated with the processing of Personal Information. We encourage you to keep watch for communications that are suspicious, and report any suspicious activity to us as soon as possible.
In the event there has been a breach of our security safeguards which involve your Personal Information, including the unauthorized access, use or disclosure of your Personal Information, loss or other breach of such information, and where there is a risk that significant harm, we will notify you within a reasonable period following the occurrence of breach and, where required, report the breach to the applicable supervisory authorities.
Transfer of Personal Information outside your Province and/or Country of Residence
Your Personal Information may in some cases be transferred to jurisdictions outside your province (including outside of the Province of Quebec) and/or your country of residence. As a result, you understand that your Personal Information will be subject to the laws of jurisdictions other than your province and/or country of residence and may be available without notice to you to foreign government authorities under lawful orders and laws applicable in such jurisdictions. Regardless of the company or person who processes your information and where it is processed, we will take steps to protect your Personal Information in accordance with applicable data protection laws and this Privacy Policy.
Children's Privacy
We do not intend to or knowingly collect information from children or other persons who are under 14 years old or fall within the definition of a minor under applicable law. If you are a minor, you may not submit any Personal Information to us. If we discover that a child or minor has provided us with Personal Information, we will delete such information from our systems.
Privacy Policies of Third Parties and External Links
The Applications and Websites may contain links to third-party websites that are not owned or controlled by CosmoBlue and this Privacy Policy does not apply to such websites or the use of any data by such websites. Should you decide to navigate to any websites or webpage external to the Applications or Websites, you do so entirely at your own risk. External links to third party websites or webpages accessed through our Applications or Websites, as well as the content on such third party websites or webpages, are not investigated, assured, guaranteed, verified, monitored, recommended or endorsed by CosmoBlue. CosmoBlue provides these links merely as a convenience to you and to other visitors to our Websites, and the inclusion of such links does not imply that we endorse or recommend such websites or webpages. We specifically disclaim any liability, obligation or responsibility whatsoever for the content or use of such third-party websites or webpages. We encourage you to familiarize yourself with the privacy statements provided by all third parties prior to providing them with information or taking advantage of an offer or promotion.
Policy Changes
This Privacy Policy may be revised from time to time as CosmoBlue deems necessary or advisable in its sole discretion. We will post any privacy policy changes on our Applications and Websites and, if the changes are significant, we will provide a more prominent notice. You will continue to have the ability to opt out of new non-essential uses or disclosures.
