Contest Rules
CINEPLEX STORE MONTHLY CUSTOMER SURVEY CONTESTS (each a “Monthly Contest”, collectively, the “Monthly Contests”)
By entering a Monthly Contest, you acknowledge that you have read, understood and accept the terms and conditions below.
Sponsor: Cineplex Entertainment LP (“Cineplex” or “Sponsor”) is the sole sponsor of the Monthly Contests.
THE PRIZE:
One (1) $100 Cineplex Entertainment Gift Card will be awarded per Monthly Contest (the “Gift Card” or the “Prizes”). The gift cards are subject to the terms and conditions on the back of the Gift Cards.
All other costs and incidentals not specified to be part of the Prizes, including but not limited to all taxes (where applicable), are the winner’s responsibility.
The Prizes are not transferable without the Sponsor’s written consent, and cannot be substituted by winners for cash or otherwise and must be accepted as awarded. The Sponsor reserves the right, in its absolute discretion, to make substitutions of equivalent kind or value, including issuing a cash prize in the amount of the approximate retail value stated above, in the event of unavailability of all or part of the Prizes for any reason whatsoever.
HOW TO ENTER
A separate Contest will be held each month, that will start at 12:01:01 a.m. EST on the first day of each month and end at 11:59:59 p.m. EST on the last day of each month (the “Monthly Contest Period”), from February 2019 through December 2023.
No purchase is required. To enter a Monthly Contest, you must click on the survey link offered in the invite emailed to Cineplex Store customers, and complete the full survey. You must be the original recipient of the Cineplex Store Customer Survey email invite and have completed the full survey. Only Cineplex Store customers who have made a transaction with the Cineplex Store since the start of each Monthly Contest Period will receive the Cineplex Store Customer Survey email invite. Eligibility for each Monthly Contest is based on the month within which you received your email invite. Entry into the contest will be open for thirty (30) days from the date you received your email invite.
To enter a Monthly Contest without making a purchase send your name, full mailing address (including city, province, postal code), email address and a hand written 50 or more word essay about your favourite movie (the “Essay”), in a postage paid envelope bearing sufficient postage to “Cineplex Store Monthly Customer Survey Contest”, c/o Cineplex Entertainment LP, 1303 Yonge Street, Toronto, ON M4T 2Y9. Mail-in entries will be entered into the Monthly Contest for the month in which the entry is post-marked, not received. All mail-in entries must be received within three business days from the end of the month to be eligible and will not be carried over to the next Monthly Contest. For
The chances of winning depend on the number of eligible entries received during each Monthly Contest. Entries will not be carried over from one Monthly Contest to the next.
ELIGIBILITY:
The Contest is open to legal residents of Canada who are thirteen (13) years of age or older at time of entry. You are not eligible if you are (or you live with) an employee, representative, or agent of the Sponsor or any of its affiliated companies, licensees or Empathica Inc. dba InMoment (“InMoment”), (collectively, the “Related Parties”). Sponsor reserves the right to verify the age of potential prize winner and that such person is not an employee of or domiciled with an employee of the Related Parties. Void where prohibited.
THE DRAW:
Sponsor will select the potential Prize winner for each Monthly Contest by random draw to be held in Toronto, Ontario approximately one month from the Monthly Contest entered. For
If any of the potential Prize winners are under the age of majority in his/her province of residence, the parent or legal guardian of the potential Prize winner may be required to sign the Declaration and Release Form on behalf of their minor child. If the parent or legal guardian of the potential Prize winner does not accept this responsibility, the potential Prize winner will not be awarded a Prize.
The Prize for each Monthly Contest will be awarded to the winner within 4-6 weeks of completion of the winner verification process.
OTHER RULES:
By entering, contestants agree to abide by these Contest rules and all decisions of the Sponsor will be final and binding on all entrants. The Monthly Contests are subject to all applicable Federal, Provincial and Municipal Laws.
The Sponsor shall not bear any liability for (a) entries which are incomplete (or otherwise improperly completed), delayed or destroyed as a result of failure of the website or technical problems or traffic congestion on the Internet, (b) the loss, theft or misuse of the Prizes, or (c) any property damage, personal injury or misfortune in any way attributable to the Monthly Contests or the Prizes (including, in the case of on-line entries, injury or damage to any on-line systems, servers, access providers, computer equipment or software) or resulting from downloading any material from the Monthly Contest website.
No correspondence will be entered into except with the selected entrants who qualify to win a Prize. By accepting a Prize, the winner grants the Sponsor the right to use the winners’ names, comments and/or city and province of residence, without further compensation, in any advertising or publicity. All entries become the property of the Sponsor who assumes no responsibility for any failure of the website during the promotional period, for any problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are obtained through fraudulent means or through an abuse of the Cineplex Store Monthly Customer Survey Contests or in any way tampered with, forged, mutilated, illegible, incomplete or mechanically reproduced will, at the sole discretion of the Sponsor, be disqualified.
The Sponsor may cancel, suspend or modify the Monthly Contests or any portion hereof at any time or for any reason without further notice if any factor interferes with the proper conduct of the Monthly Contests, including, but not limited to, a virus, bug or any other cause of any nature beyond the reasonable control of the Sponsor corrupts the security or proper administration of the Monthly Contests, subject to the approval of the Régie des
Any personal information you provide by entering this Contest will be used only to administer these Monthly Contests, and for no other reason and at all times will be collected, used, stored and destroyed in strict accordance with Sponsor’s and InMoment privacy policies and all applicable privacy legislation. By entering this Contest you consent to (i) InMoment providing the Sponsor with such information as is necessary to permit the Sponsor to contact you should you be selected as a potential Prize winner; and (ii) the Sponsor contacting you should you be selected as a potential Prize winner. The responses to the survey questions that you provide will be used by the Sponsor and InMoment in an aggregated manner only and will not be linked to your personal information. No Liability: None of the Related Parties, or their respective parent, subsidiary or affiliated entities, or each party’s officers, directors or employees (collectively, the “Released Parties”) shall be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prizes awarded in this Monthly Contest or the events forming part of these Monthly Contests. By participating or accepting a Prize, all entrants release and hold harmless the Released Parties from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in a Monthly Contest or acceptance, use, misuse or non-use of the Prize or parts thereof, and from liability to any other persons relating to or resulting from entering a Monthly Contest.
Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of the Monthly Contests or the Contest Rules or the rights and obligations as between the entrants and Sponsor in connection with the Monthly Contests shall be: (a) governed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws; and (b) resolved individually without resort to any form of class action. All parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Monthly Contests or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario. For Quebec resident’s only: Residents of the province of Quebec may submit any litigation respecting the conduct of this publicity contest to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
Language Discrepancy: In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, or of any contest materials or Declaration and Release Forms, the English version shall prevail, govern and control.
